Rule 5
Recruitment of Military Technical Services
(1) Only by promotion to the post of Commissary of Military Technical Service and above and other posts mentioned in Schedule 3 will be filled through open competition, promotion and internal competition.
(2) For the positions filled by internal competition for the posts of Amaldar and Subedar of all groups and sub-groups under the military technical service, soldiers working in any service; group of the Nepali Army who have attained the minimum educational qualification required for that post can be candidates. (3) According to this regulation, except for having the minimum educational qualification required for the post of general and above, the sub-soldier who is appointed through internal competition according to this regulation can only be promoted to the rank of major general. But this provision will not be applicable in case of military band sub-group.
(4) Subedar who has completed ten years of service in the post of the relevant group and who has attained the required educational qualification for the post to be filled by internal competition for the post of sub-senior as per sub-rule (1) can be candidates.
(5) Soldiers belonging to any group or sub-group of the Military Technical Service shall not be promoted to the post of another group or sub-group.
(6) Notwithstanding anything written in sub-rule (1), forty-five percent of the posts to be filled through open competition shall be reserved and the said percentage shall be considered as 100%, and the posts shall be filled by separate competition only among the following candidates:-
(a) Women-twenty percent (b) Tribals/Tribals-thirty-two percent (c) Madheshi-twenty-five percent (d) Dalits-fifteen percent (e) Backward Areas-five percent Explanation:
(1) For the purposes of this sub-rule, “women, tribals/tribals, Madhesi, Dalits” means economically and socially backward women, tribals/tribals; Madhesi and Dalit should be remembered.
(2) For the purpose of clause (e): "backward area" means the districts of Manang, Mustang, Acham, Kalikot, Jajarkot, Jumla, Dolpa, Bajhang, Bajura, Mugu and Humla.
(3) I am a candidate according to clause (b), (c) or (d).A person can only compete as a candidate of a group of one section.
(4) For the purpose of filling posts according to this bye-law, the details of economically and socially backward women, tribals/tribes, Madheshi and Dalit groups shall be as specified by the Government of Nepal by publishing a notice in the Nepal Gazette. However, all women, tribals/tribals, Madhesi and Dalits will be given financial and social benefits by publishing a notice in the Nepal Gazette until further notice. It will be considered backward.
(5) The following documents should be attached while applying for the posts allotted in accordance with this sub-rule:-
(a) For tribals/tribes who have been certified as tribals/tribes by the Nepal Tribal/Tribal Upliftment National Institute, but listed by the chief district officer on the recommendation of the head of the local level if there is more than one surname within the tribe listed in the Nepal Tribal/Tribal Upliftment National Foundation Act, 2058 It should be submitted along with the application after proving that it is a surname within the caste.
(b) For Dalits who have been certified as Dalits by the National Dalit Commission, but have more than one surname within the caste listed by the National Dalit Commission, on the recommendation of the head of the local level concerned, the application must be certified as a surname within the caste listed by the Chief District Officer.
(c) For Madhesi, the Government of Nepal shall publish a notice in the Nepal Gazette and certify that they are Madhesi from an institution as specified, but until the institution is published in the Nepal Gazette and the institution is designated, they shall be certified as Madhesi by the chief district officer and submitted with the application.
(d) A certificate of citizenship obtained from the relevant district stating permanent residence in the district mentioned in sub-section (2) of the explanation for backward areas and a certificate from the relevant village municipality or municipality confirming that he is currently residing permanently in the same place. (7) In determining the percentage according to sub-rule (6), if a coefficient (fraction) of less than one percent is found, such coefficient which is found in the case of the groupAfter that, it will move to the next group.
(8. According to sub-rule (6), if a suitable candidate is not available in the advertisement for the year for which the advertisement is made, or if the required number of candidates do not pass, the position cannot be filled, the candidate will be included in the advertisement for that year in the same advertisement.
